Claims Specialist - LitigationInvestigates, analyzes, and determines the extent of Progressive's liability concerning loss or damages, and attempts to effect settlement with claimants and insureds primarily through the litigation process. Corresponds with or interviews medical specialists, agents, police, medical professionals, witnesses, insureds or claimants to compile and analyze information. Develops recommendations and plans for litigated claims.
Duties and Responsibilities: •Investigates coverage by reviewing the policy and applicable coverage, gathering information necessary to apply coverage and referring files to claims attorneys for declaratory action when appropriate •Investigates liability by reviewing evidence already gathered such as pictures and recorded statements •Attends in person meeting with insureds to ascertain facts •Evaluates all types of injuries in litigation from soft tissue to serious joint injuries, severe fractures, scarring, emotional distress, carpal tunnel syndrome, disc hernias, traumatic brain injuries and fatalities •Reviews litigation discovery for information •Investigates and evaluates damages by obtaining and reviewing medical records, bills, employment and wage information •Directs defense attorneys regarding experts or to subpoena missing information •Researches injured persons prior medical history and prior claims experience as well as reviews litigation discovery for additional medical providers •Recognizes and analyzes exposures while devising defense strategy •Provides status reports on the claim throughout different stages to management by completing thorough initial lawsuit reports, reevaluations, resolution discussions, trial reports and trial setting notices. •Negotiates over the phone, through alternative dispute resolution processes or in person •Participates in suit status reviews by presenting files for discussion with defense attorneys, managers and claims attorneys •Attends depositions, pre-trials, settlement conferences and trials
Knowledge, Skills and Experience: •Strong negotiation skills •Excellent organization and problem-solving skills •Ability to multi-task and prioritize •Effective team player •Strong customer service skills •Proficient in basic computer skills •Commercial claims handling experience is a plus- Bachelor's degree or a minimum of 4-7 years of relevant work experience and/or postsecondary education.
